New Mexico Abstinence Coalition Sues Governor For Allegedly Withholding Information On How It Spends Federal Sex Education Funds

An attorney for Laurel Edenburn, president of the board of directors of the New Mexico Abstinence Coalition, on Monday filed a lawsuit in a state district court in Santa Fe against Gov. Bill Richardson (D), alleging that his administration is withholding information about how it allocates federal funds for sex education, the Santa Fe New Mexican reports (Sharpe, Santa Fe New Mexican, 12/15). HHS in May said that schools in New Mexico would lose federal funding for sex education if they tried to limit abstinence-only education to grades six and below after State Health Secretary Michelle Lujan Grisham in 2005 announced that the state would use its $500,000 federal abstinence education grant for sex education programs directed at elementary school students (Kaiser Daily Women's Health Policy Report, 5/8). Edenburn said that when she requested files in October about how the sex education funds were being spent, state officials declined to give her all of the financial records and withheld some information in the files, citing executive confidentiality rights. Edenburn in the suit said that the state's open-records act requires disclosure of state expenditures. Richardson's office in a statement said, "We are currently reviewing this complaint," adding, "We provided her with more than 100 pages of documents in a timely, expedient manner.' Edenburn filed a similar case on March 31 against Lujan Grisham that is pending before state District Judge Daniel Sanchez. Sanchez also will hear Edenburn's new complaint (Santa Fe New Mexican, 12/15).
