Why aren't there height restrictions for trees?

Q: A neighbor has planted fast-growing trees that eventually will block my view. Why do we have height restrictions for newly built dwellings and fences, yet none for trees?

A: Very few neighborhoods, like Innis Arden in North Seattle, have view easements or restrictive covenants that prohibit trees from blocking views. However, in general, you're correct that built structures must abide by zoning height regulations, but trees are free to grow and grow and grow. Why? "Because we're not building a tree; nature is building a tree," says John Petersen, a City of Seattle arborculturist (tree and shrub specialist). And homeowners are pretty much free to plant whatever kind of tree they want wherever they want on their property as long as it's not a safety hazard. The most obvious example of that, Petersen says, is a tree that grows into power lines.

 

Petersen has heard many tales of neighborhood tree feuds and suspects that most begin innocently enough. "A lot of conflict arises when new neighbors move in and immediately cut down trees the whole neighborhood has cherished," he says. Or homeowners "just think they'd like a tree and they plant one without a lot of thought about what it will grow into." Petersen's advice: Consider carefully before terminating or planting a tree.

The City of Seattle's Urban Forestry Web site, www.seattle.gov/transportation/forestry.htm, offers information about appropriate and inappropriate choices as well as the height and crown spread of numerous trees. Plant a swamp white oak, for example, and expect it to reach up 100 feet, while a Magnolia grandiflora will max out at about 15 feet tall. The National Arbor Day Foundation's site, www.arborday.com, has an extensive tree library complete with photos and information about each type.

Finally, Petersen suggests that homeowners considering planting a tree first take a stroll through the Washington Park Arboretum (parking at the Graham Visitors Center, 2300 Arboretum Drive E., Seattle). It has a vast collection of trees. "They can walk there and see what a tree is going to look like in 25 years," he says.

Q: I put a deposit down on an apartment, but my roommate didn't pass the credit check and we didn't move in. The apartment manager kept the deposit anyway, with the explanation that I did pass the credit check. Is this legal?

A: That depends on how the application and the deposit receipt were written, explains Steve Fredrickson, advocacy coordinator with the Northwest Justice Project, a provider of free legal assistance for low-income people involved in civil cases. Fredrickson says the state's landlord-tenant act requires any landlord who collects a move-in fee or deposit to "first give the tenant a written statement under which the deposit or fee will be refundable. If it isn't refundable, then that should clearly be disclosed in writing.

So if those disclosures were not made, or they were not accurate, then you may have the right to get this deposit back."

If after reading your documents you think you have a case, write to this landlord requesting your deposit be returned. If that doesn't do the trick, try small-claims court. The law gives you six years to pursue a claim based on a written contract, three years if it's a verbal contract. "But sooner is always better than later," Fredrickson says.

Q: My partner and I have set up an LLC for the purpose of buying, renovating and selling single-family homes. However, I was told that to get home loans, these properties can't be purchased in the LLC's name. Therefore, I bought them in mine. Can I now quit-claim the properties to the LLC, and would that have tax implications? And if a quit claim isn't the right instrument, how do I get these properties into the LLC so my personal assets are protected?

A: LLC stands for limited liability company, a type of business entity (others include corporations and partnerships) that can have tax advantages. Tax attorney Roger Lageschulte says it's likely lenders wouldn't let you purchase properties in the LLC's name because the LLC itself had no assets and no credit standing. Quit-claiming the properties to the LLC could create both excise-tax and gift-tax obligations, Lageschulte says. It also could draw the attention of your lender, who might be within its rights to call the loans.

Meanwhile, if only your name is on the loans you quit-claim to the LLC, you may have created a situation where your LLC partner essentially has half ownership but you bear all the responsibility for making the payments.

So what to do here? Lageschulte strongly suggests you consult an attorney skilled in real estate and taxation who can more precisely answer your questions and protect your financial interests.
