Barr to refile Plan B contraceptive application
Barr Pharmaceuticals Inc. will resubmit a request to sell its morning-after contraceptive pill without prescription, the company said on Tuesday after meeting with U.S. Food and Drug Administration officials.
Last week the FDA proposed allowing Plan B to be sold without a doctor's order for women 18 and older from behind the pharmacy counter, adding it would reopen discussions with Barr which had sought to sell the drug to women 16 and older.
"In response to FDA's comments, Barr intends to have a submission back into the FDA in the next two weeks," Barr spokeswoman Carol Cox told Reuters.
Cox and FDA spokeswoman Susan Bro described the meeting between the parties as "productive."
Shares of the drugmaker closed up 58 cents, or about 1.2 percent, at $51.23 on the New York Stock Exchange.
The company's bid to sell Plan B -- a set of two pills that can prevent pregnancy if taken within 72 hours of sexual intercourse -- without a doctor's note has stirred fierce lobbying of the agency by supporters and critics.
Democrats have also held up Senate confirmation for U.S. President George W. Bush's pick to lead the FDA, Acting FDA Commissioner Andrew von Eschenbach, until the agency makes a final decision on the product.
Plan B was approved in 1999 as a prescription drug. The first application for over-the-counter status was filed 2003.
The drug's supporters say easing access will lead to fewer abortions, while critics argue wider availability will increase promiscuity.
Some abortion opponents also object to Plan B because some research suggests it may keep a fertilized egg from attaching to the womb. The FDA says Plan B - a high dose of a birth control hormone - works mainly by blocking the release of an egg from an ovary. The drug also may prevent an egg and sperm from uniting.
